These Terms and Conditions govern the use of the Niche Design Studio website, products and services. By using this website, requesting a quotation or engaging our services, you agree to the terms outlined below.

1. About Niche Design

Niche Design Studio specialises in:

* Interior Design

* Space Planning

* Furniture Procurement

Throughout these Terms, “Niche Design”, “we”, “our” and “us” refer to Niche Design Studio.

2. Acceptance of Terms

By browsing our website, requesting a quotation, booking a consultation or purchasing any products or services, you agree to be bound by these Terms and Conditions.

If you do not agree with these Terms, please do not use our website.

3. Products

Many of our products are:

* Made to order
* Custom manufactured
* Handcrafted
* Specially sourced
* Produced to customer specifications

Because every item is individually produced, slight variations may occur in:

* timber grain
* colour
* stitching
* fabric texture
* natural stone
* dimensions (within manufacturing tolerances)

These variations are not considered defects.

4. Product Images

We make every effort to display products accurately.

However:

* colours may vary due to monitor settings
* textures may differ slightly
* décor shown in photographs is for styling purposes unless specifically stated

Images are for illustration purposes only.

5. Interior Design Services

Our design services include concept development, mood boards, layouts, furniture selection and procurement assistance.

Unless otherwise agreed in writing:

* concepts remain the intellectual property of Niche Design until paid in full
* quotations are estimates only
* suppliers may discontinue products without notice
* substitute products of equal quality may be recommended

6. Custom Furniture Orders

Custom furniture includes any item:

* built to specific dimensions
* upholstered in customer-selected fabrics
* manufactured to customer requirements
* modified from our standard range

Because these products are custom-made:

All custom furniture sales are final.

No refunds, cancellations or exchanges are permitted once production has commenced.

7. Pricing

All prices are quoted in South African Rand (ZAR).

Prices may change without notice.

A quotation remains valid for the period specified on the quotation.

Supplier price increases occurring after quotation expiry may result in revised pricing.

8. Deposits

Unless otherwise agreed:

Custom furniture orders require a 70% deposit before manufacturing will commence.

The remaining balance is payable before delivery or installation.

Design services may require a booking deposit as indicated in your quotation.

9. Payment

We accept approved payment methods displayed on our website.

Orders will only be processed once payment has cleared.

Failure to make payment may delay production or delivery.

10. Manufacturing Lead Times

Lead times are estimates only.

Typical lead times range from:

* 5–8 weeks for custom furniture
* subject to supplier availability
* public holidays
* transport delays
* manufacturing capacity

We cannot guarantee exact completion dates.

11. Delivery

Delivery fees are quoted separately unless otherwise stated.

Customers must ensure:

* access to the property
* sufficient door and stair clearance
* someone is available to receive delivery

Additional delivery charges may apply where access is restricted.

Risk transfers to the customer upon delivery.

12. Installation

Where installation services are included:

Customers are responsible for ensuring:

* safe site access
* completed building work
* availability of electricity where required

Installation dates may be rescheduled due to weather, supplier delays or circumstances beyond our control.

13. Inspection Upon Delivery

Customers should inspect all items upon delivery.

Any damage or shortages must be reported within 48 hours.

Claims made after this period may not be accepted.

14. Returns, Refunds & Exchanges

Custom Furniture

Because our furniture is made specifically for each customer:

We do not offer refunds, returns or exchanges on:

* custom furniture
* made-to-order furniture
* upholstered items
* customised décor
* specially sourced products

This includes changes of mind.



Standard Products

If a standard, non-custom product is found to be defective upon delivery, please contact us within 48 hours.

Where applicable, we will inspect the product and determine an appropriate remedy in accordance with the Consumer Protection Act.

15. Cancellations

Orders may only be cancelled before production begins.

If manufacturing has commenced:

* deposits become non-refundable
* any costs already incurred will be payable

Design consultation bookings cancelled less than 48 hours before the appointment may incur a cancellation fee.

16. Warranty

Manufacturer warranties apply where offered by the supplier.

Warranty does not cover:

* misuse
* neglect
* water damage
* sun fading
* pet damage
* accidental damage
* improper cleaning
* normal wear and tear

17. Natural Materials

Products manufactured using:

* timber
* leather
* linen
* marble
* stone
* woven fibres

may naturally vary in colour, texture and grain.

These characteristics are not defects.

18. Intellectual Property

All website content including:

* renders
* drawings
* concepts
* floor plans
* photographs
* mood boards
* graphics
* logos
* text

remain the exclusive property of Niche Design.

No material may be copied or reproduced without written permission.

19. Website Use

Users agree not to:

* misuse the website
* attempt unauthorised access
* upload malicious software
* interfere with website functionality

20. Quotations

All quotations are subject to:

* supplier availability
* manufacturing capacity
* price changes
* transport costs

Quotations expire on the date indicated.

21. Third-Party Suppliers

Niche Design works with carefully selected suppliers.

While we coordinate orders, we are not responsible for:

* manufacturer delays
* discontinued products
* supplier shortages
* force majeure events

We will always communicate delays where possible.

22. Limitation of Liability

To the fullest extent permitted by law, Niche Design shall not be liable for:

* indirect damages
* consequential loss
* business interruption
* loss of profits
* delays beyond our control

Our maximum liability shall not exceed the amount paid by the customer for the relevant product or service.

23. Force Majeure

We shall not be liable for delays resulting from events beyond our reasonable control including:

* floods
* fires
* strikes
* supplier failures
* transport disruptions
* pandemics
* government restrictions

24. Privacy

Customer information is processed in accordance with our Privacy Policy and applicable South African privacy legislation (POPIA).

We do not sell customer information to third parties.

25. Governing Law

These Terms and Conditions are governed by the laws of the Republic of South Africa.

Any disputes shall be subject to the jurisdiction of South African courts.

26. Changes to These Terms

We reserve the right to amend these Terms and Conditions at any time.

Updated versions will be published on our website.
